A month-to-month tenancy continues on the same terms each period until one side gives the statutory notice.

A month-to-month tenancy is not a weaker lease; it is a different instrument. Everything about habitability, deposits and entry is identical. What changes is how quickly either side can walk.

The notice, both directions

Statutes commonly ask more of the landlord than of the tenant. California requires the landlord to give 60 days where the tenant has lived there a year or more and 30 days below that, while the tenant gives notice at least as long as the period (Civ. Code § 1946.1, checked 2026-09-04).

Plan around the longer number. On a periodic tenancy you are effectively two months from vacant, which is exactly the horizon the turnover cost calculator prices.

Changing rent on a periodic tenancy

The advantage of a periodic tenancy is that rent can move on notice rather than at a term end. The cap still applies where one exists — California's is 5% plus CPI, capped at 10%, measured against the lowest rent charged in the preceding 12 months (Civ. Code § 1947.12, checked 2026-09-04).

Flexibility should be priced, not given away

A month-to-month tenancy transfers optionality to the tenant. A modest premium over the 12-month rate is the market's normal price for it, and it is easier to justify at signing than to add later.

When it is the right instrument

  • You may sell, occupy or renovate within the year.
  • The market is short-let heavy and 12-month terms are hard to fill.
  • The tenant is new to you and you want an exit that is not an eviction.
  • Rents are moving quickly enough that a fixed term would leave you behind.

Against that: vacancy arrives with less warning, and a good tenant can leave in 30 days. The trade-off is worked through in lease vs rental agreement.

Ending it cleanly

In a just-cause jurisdiction a periodic tenancy cannot be ended without a stated statutory reason. A no-reason notice there is simply defective, and the tenancy continues.
